Nick Deenis represents financial services companies, insurers, fidelity and surety companies, and other commercial entities in a wide range of legal commercial disputes. His complex litigation defense practice focuses on insurance defense litigation, including acting as counsel for insurers in the National Flood Insurance Program. Additionally, Mr. Deenis is highly active in counseling financial services clients, officers and directors in the emerging cybersecurity and data breach risk management and litigation field. He brings a growing expertise not only in the legal requirements imposed on entities exposed to data breaches and cybersecurity threats, but he also counsels clients on the best practices in risk management, including securing proper cybersecurity and privacy insurance products.
Mr. Deenis has extensive experience representing national and local banks, focusing on claims under the Uniform Commercial Code and the several related federal and state statutory and regulatory requirements imposed on banks in the check collection process. He has extensive litigation experience in check fraud and related claims and counsels banks on an ongoing basis regarding such check fraud claims and electronic transfers.
He also routinely counsels banks and other financial institutions and represents them in litigation in a wide variety of state and federal consumer protection claims, including the Fair Credit Reporting Act, the Truth-in-Lending Act and Regulation Z, the Real Estate Settlement Procedures Act, the Fair Debt Collection Practices Act, the Equal Credit Opportunity Act, and state unfair trade practices and consumer protection laws.
